As previously said unfortunately you don't apply for stat warranty. Cars in WA need to be over 4k to apply. Technically the dealer doesn't have to do anything. Anything they do for you will be out of good will. As p!ssed off as you are a friendly approach will probably get you further in this situation.
If you bought an extended wty that might cover it but read the contract/covered items carefully. You will generally have to pay the first x amount and they don't usually cover things like coolants, oils etc so that will be out of your own pocket.
If it's not covered and the dealer doesn't want to play the game you'll be able to get head done for under a grand on a charade easy.
If you haven't got a decent mechanic let me know. I know a good one who does the right thing.

Dog, that's good advice... But I was thinking someone would come up with the "winner" answer, in terms of "X days legal cooling off period, for WA cars, over X amount, etc.."... Or vice versa... "you are screwed because..."... ?!?!?
Trade the "lemon" in at a dealer that offers $3000 bucks for your old licenced bomb - there is a couple of them in WA ![]()
You do know that someone promising you $3000 for any trade-in is obviously adding 3k to the price don't you? Car dealers aren't stupid and if they get a car they consider unsellable, they just wholesale it to someone else for almost nothing. Guess who pays for that 'next-to-nothing'?

I thought it was 3k and under= no warranty. 4k, thats poor.

Is this true? I thought warranty laws applied to everything you buy. period. Even though its a cheap car, it should last a little while. I dont know if I agree about not being covered by consumer law. It has changed recently and become even stronger (and the term 'statutory' has been dropped. I would check out the federal consumer law website.

Regardless of warranty I think any big dealership would do the morally right thing and take the car back - it only made it a few km and it was not even hot weather and it farked up badly. I bet it would have failed cylinder leakdown and/or comp tests but I also bet they didn't bother. Change the oil, shonky paint touchup (if you're lucky) polish and out the door at triple $$$ that they traded it for. ![]()
Uphill isnt a big dealership, Im not sure on the warrenty side of it, I think they only have to warrent a car if its 5k or more and under 5k you have to buy one?? Not sure I havnt looked at the rules for a while and they change a bit. It should be all online anyway, I sell parts not cars ![]()
Buying second hand is a risk no matter how you look at it. Doing the research and buying smart are the ways to go but hindsight is a wonderfull thing.

But in saying that the car should not have been sold at all as the chaise had major
rust in it (it was almost rusted through).

Ok, on sat i signed a stat dec saying i was returning the car within 24 hours due to problem. Today spoke to and lodge a complaint with consumer protectuon.
Then i called dealership informing them the car was unfit for its purpose and saftey issue if it breaks down in traffic and demanded the mechanics number that the car was at. They did not give it and They got a little pissed. Then they called back said it was a head issue and have given me a cheque with the full amount of cash back. So all worked out well. Big thabks for the advice, especially as many of you giys are pole dancers!! (i did return a wave sail and boom i found at bombing range last year so good karma i giess!!)
