Kiting banned in Ballina Shire?

I read this in another thread www.seabreeze.com.au/forums/topic.asp?TOPIC_ID=63938 .Is it true ?If it is it is really sad and has implications for the rest of Australia .I know that the main beach in Byron was off limits but this seems a bit much.

There was about 8 kites out at flat rock the other day.. didn't look very banned to me.

I'm pretty sure they were all kiting knowing the ban was active a month or so ago. We had a lot of problem with a few local longboarders in the area who didn't like us for some reason or another and unfortunately a couple of them are on the council board and have a bit of sway. We stopped them one other time with a 8 to 3 decision not to ban it but this time we weren't so lucky.
I was actually about to get my gear out of the car when I saw the waterways guy pull up (same guy that gives us problems with jetskis at the boat ramp for doing tow-ins) just the other day, I think he thought I was just there to check the surf so I followed him down to the lookout and back up to the car park again, when we got back there I watched him for a bit and he was looking in cars and taking down number plates. I'm not sure if it was for giving fines or just keeping tabs to follow it up next time... Anyway, it's not gonna stop me kiting there but at least now you know.

Be interesting to see if anyone tests the ban. Pretty toothless local laws are. Local authorities only have jurisdiction above high tide mark and waterways is state authority.

No signs = no infringement notice can be given.

Checked with the lifeguards cruising the beach at Lennox yesterday, no ban that they know of. Was between the SLSC and the Pub too.
