I have my boat in a NSW marina berth and recently the fees were increased without notification of any type. I contacted Fair Trading in attempt to try to ascertain if a notification period was a requirement but was told that marinas are not covered by the Tenancy Act. I would have thought that even under a lease agreement that some sort of notification would be a legal requirement. Maybe not!
Has anyone else been through this situation?

fairly sure that if you re-read your lease in the fine print you will find it says marina fees are subject to change without notice. Sucks that marina berths are not considered to be a residence under the residency tribunal even if you live aboard, but that's government for you, it doesn't have to make sense, it just wants your dollars.

Get a mooring licence upon which the fees are reasonable and only increase by CPI.

My mooring costs me 91 cents per week.

Moorings are not that easy to obtain in Vic Cisco

Down here we have "Wet Lands" not "Swamps" if you know what I mean

The rent has been increased by 8.3%, not a huge amount but another small turn on the knob that controls what the market can bear, I guess!

No need to re-read the lease, its there in easy to see print that the marina fees can increase at anytime without notice. My interest was in the notification of such increases. I was thinking that Fair Trading would have a view on it but they informed me that their act also excludes those that choose to live in Residential Parks and Caravan Parks etc. I guess its as simple as the lease says " anytime without notice" and you then have the option of voting with your feet, or your hull.

I agree with cisco and if you cant get one like me, get an oversized anchor, I attach an old tinnie to it when I leave.
Yes there is a bit of inconvenience then being in a marina but at least I have a healthy bank balance (hang on, not really I just have more money to spend on boat )

Yes we all understand that Marinas are more expensive than moorings. However Windsong may choose to pay for the Marina for other reasons. It maybe the convenience of just being able to step aboard to do work on his boat whenever he wants. It may be for a medical or physical reason or he may be a liveaboard. Unfortunately in my experience Marinas can put their fees up whenever they wish because generally the good ones have a waiting list so I guess they figure if they lose a few people they can usually fill their place easily.

Windsong you wouldn't be talking about the recent fee rise at Marmong Point Marina would you? We have a few friends on the marina who are unhappy about the recent increase in their fees. Guess they are planning to use it fo the redevelopment there and at Koolewong?

No Watermark I don't mean Marmong Point Marina but I Know it and have taken my boat out there.
You mentioned a redevelopment there and at Koolewong, is that the Koolewong on Brisbane Water?

Yes that is right. They have approval to build a 50 berth marina in Murphys Bay by the Boathouse restaurant. It is due to be built this year. If you google Koolewong marina the web site tells all about it.
