I would argue that if you abandon equipment in the sea, whether deliberate or by accident you will be liable for any damages it may inflict on other persons whether deliberate or accidental. Leaving debris in the water will be deemed a hazard to other water users and the fact that you are sharing a limited space only in forces the point further. The same goes with hitting someone with your kite, getting your lines wrapped around other people or hitting people by landing on them. It is your responsibility to be safe and make it safe for others around you.
To argue that someone is going to fast will not lead anywhere, they can equally argue that jumping is dangerous. Any long fight will lead to unfavourable measures being imposed on the rest of us.
I am amazed at the damage to your board, however on the negative side now they all know :( so I hope it does not encourage them.
Pretty funny how all the windsurfers say that the board was 'abandoned' so it's fair game to plough over it, if they got separated a few metres from their kit and a kiter ran over their expensive sail, ripping it to shreds, they would all be on here crying like the bunch of fairies that they are.....![]()
the whole - kite area vs windsurf area is an agreement between the 2 sporting bodys. Can this even be legally enforced?
When approacing a downed kiter pretty much the only option you have is to pass upwind of him cause you know for a fact that the kite and lines (which are hard to see) are going to be downwind.
There is only so much you can bear into the wind so your pretty much limited to where you can go. your priority is generally on the guy in the water so chances are you are not going to see a board floating in the water in that nice narrow corridor hes forced you into.
Seabreeze is not the place if your looking for a shoulder to cry on..
At least you will be thinking twice when kiting around windsurfers in future.
yes the board is fixable. but not without a stringer of glass on either side. it will need a repaint or look like complete crud.
who should pay for the repair? insurance!
but if we look at road rules. if a moving vehicle hits a stationary object..... its the moving vehicle thats at fault. not sure how that translates to the water. But imagine if it was a baby floating in the sea and the windsurfer killed the baby. who he be at fault?????

I would not think a windsurfer would deliberately ride over a board - 1 self-interest - cost to fix thier own kit, 2. they are (should be) inclined to be helpful towards kite surfers (that is my experience - but I am not in a busy metro' zone).
It looks like an unintended accident. The pros and cons of the rest of the views are fun but not worth making a judgment on.

, U can get it fixed by a pro' (assuming it is possible
), if it does not loose too much flex' U R unlikely 2 notice.
Would be interested in knowing the outcome - re-fix options.

Yep I'd say it's a case of suck it up and move on,s**t happens been riding before myself an had to jump over a board and the guy who lost it body dragging 200 meters away ,didn't have a clue where it was and hard to spot when your blasting over a wave,just one of those unfortunate things maybe the windsurfer was more intent on making sure he didn't collide with you.
Yep **it happends, but surely if the windsufer was onto it he would have seen you body dragging and would have thought "there will be a board floating here somewhere, I should turn around or slow down so I dont damage my own gear??"
Sounds like good old common sense was lost on this bloke.
If he has damage to his dancing platform he might have learnt from his mistake. You would hope anyway.
Are you taking a poll? I vote you each pay for your own repairs - it's just easier! If you're out on the water enough, something will get broken one way or another.

As a former windsurfer of 25 years and now a kiteboarder of 3 years I just cant see where this is going unless we want to take on the US system of litigation. Was it a malicious act - nope!
I would never aim my sailboard at any solid thing for fear of damage and injury ( ie kiteboard in the water) and likewiase I would never consciously do the same now that I am kiteboarding ( sometime on a TT but mostly on a surfboard with decent fins - injury and damage are the same drivers!).
As an ex pole dancer, kite lines scare the **** out of me - get caught in them without a safety knife and things arent so good ( thats why I carry a knife always)
So as many have said sh*$ sometimes happens and strangely SO DO ACCIDENTS WHERE NO ONE IS TO BLAME - but if you think it was a bit malicious :( move to the US please !!!
When accidents happen a gentlemens agreement is the usual AUSTRALIAN way

I just read the headline and looked at the board in question .I think destroyed is an overstatement .one of my boards broke in half and was repaired by a mate who kindly offered to fix it.I have had two more years of enjoyment on it.
