is it possible for you (Laurie) to investigate now . . . help sort out the situation . . . maybe you already are involved . . . if so great . . .

if this is not resolved, then us forum users really should be informed about the seller . . . otherwise how can we have confidence for future dealings . . . even if this is a one in 3 year event . . . i would not want to be that one . . .

Vasco, did you try to make a claim to paypal also? I know a couple people who have dealt with ebay scammers have been able to get a refund via paypal. I'm sure you've already tried this and all other options though. I hate to point the gun but you really should have known not to send money to anyone without a middle man.

It actually reminds me of the time I bought my first kite (my only kite) a couple months ago. It was through Seabreeze classified. $1100 for a Nobile N62. Sent as a COD payment. I waited a week for the post office to call me when one friday, I think 8 days after I bought the kite they delivered it to my front door and just left it there. Nobody was home and a $1100 kite was sitting there all day on my doorstep. Luckily I came home and it was still there. If you don't know COD, you're meant to pickup and pay for your item once it's delivered to your local post office.

Anyway, the seller being a member of Seabreeze I couldn't rip him off, so I went into the post office and gave them the $1100 and let them know of their mistake... Damn were they happy! Baha. They were so thankful and told me that the delivery guy ****ed up HARD and he would have been the one responsible to pay for it! Damn, he would have gotten his money anyway! Oh well I would have liked to rip the post office off for all the times they've lost my mail, but all in all I felt good for doing a little good deed and my reputation as a kite was not tarnished!

i'm fairly certain that if you read the fine print over at Paypal, they don't 'guarantee' transactions outside of eBay and if a case is decided in your favour you still maybe not get your money back!

I've personally been through the Paypal eBay dispute process and its takes a long time (weeks to months) to see your money again!!!

Hi guys, tks for sugguestions. Before all this I started I did start a dispute with Paypal and finally had that resolved in my favour - but it only gives me my money back if the guy ever tries to use Paypal again. The rules of Paypal state that if the purchase has been made on ebay and you win Paypal refunds it regardless but anything outside that requires a positive balance in his Paypal account for them to refund me.

All of this information was already on the part of the posts that were removed by the mediators.

The bad side - for him - is that he can never use paypal again with his name, his bank account, his email address, his home address or any other data he used to open his account. All that data has been flagged and will pop up in dusputes if he ever transacts over the net. ebay has also an agreement with Paypal as reciprocal information disclosure so he can't use that either - basically he's just screwed himself over 350.00... how dumb is that?

But this is not over. I am here asking for Laurie to PM me and give me his phone number from the orginal add so I can pass it onto the cops and get this matter further. You getting this Laurie right? (tks)

There is no way I am letting this lay down and I ope his mates know what kind of mess this guy is creating and the bad name this is attaching to our little community.

How does that work? Most private people have a dynamic IP, it changes every time you connect and it will only show you the ISP.
I entered my IP and it said I am located in Sydeny, but I'm pretty sure I am in Melbourne.

IMO COD is the safest way to pay for an item bought outside ebay, then open the box at the post office counter so you have a witness that can confirm if you received the requested gear or a dead cat. The post office can then hold on to the cash until the matter is resolved.

So to sumise

sir V sees a bargain - 2 ripped kites and an old bar $350 decides to buy
Sir V contacts seller, pays vi pay pal
Tuna sends items by Aust post - items don't arrive
Sir V tries to contact Tuna - However Tuna is offshore/in a mine/away from 'puter
sir V interprets this as terrorism and reports to anyone and everyone he can - except the owner of the site where he wsaw the stuff advertised
after little success sir V turns to the forum
two pages later the truth is told.

So let me try and sumarise:

1 - You don't bother to reply for .. when was your last communication? (30SEP email)
2 - you placed a complaint with the Post Office about a supposed lost article and keep no documentation or forward to me as proof
3 - you don't call, you don't write, you don't send flowers
4 - you had plenty of warning I was going to expose all this mess (my email 14 October)
5 - never offered to refund the purchase
6 - You've had my phone number since day 1 and got it repeated on everyone of my emails, mobile and work.
6 - You showed absolutely no consideration for the buyer (me)

and now you call boohoo someone called me whatever and, and, and?

Finally you place a response here saying you were refunded on Monday an extra 100.00 by the ""Pissed Office"" and still have not paid the money into my Paypal account...

I not only do not understand your communication skills but I also do not understand your English. Please read your post again and explain what you are going to do about paying my money back.

And what is that story about a beer? You mean you are going to send me a few cases for the trouble caused? Via the Pissed Office?

So let me get this right. Someone paid you for a kite, you shipped it, it got lost, you found out that Auspost ****ed up, instead of refunding him immediately, you went off on a boat and didn't bother to check mails for over a month while being on a boat knowing that the buyer was out of pocket and without a kite and couldn't get hold of you, you don't bother to call the guy to explain that you're away, and you now think the guy owes you beer because he messed up by exposing this whole saga and calling you a fraudster?

You need to take a serious look at whole you handled the whole saga because you came up way short. I would have done the same if you handled a sale with me the same way, in fact, I'm surprised he waited this long to report it to the cops.

What you should have done if this was the case was:

a) Phoned him to discuss it and apologised for the inconvenience
b) Send a copy of the proof that you posted it, so he knows you're honest and not some scamming douchebag
c) Refunded his cash ASAP. You don't have to wait for Auspost to refund it, its his money until the goods arrive
d) Keep following up with Auspost to find out whats happening
e) Actually told him you were going away so he knows that you might not communicate.

Hey Saffer... I still don't think he got it.

My feedback on ebay is 100% after more than 4 years of use, what do you reckon his is?

So, all he has to do is to make the funds available in the Paypal account and I should get the money back into may account. I also thought of sending a little bottle of Rose water, but I decided against it as it would have been a little on the cheeky side. You may also notice I have changed his name to xxxx so I wouldn't offend anyone's sensibility [}:)]

Let's see how this pans out or what other reasons are presented for further delays.

Yes PR but this way he has the opportunity to deposit the money there and clean up his act with Paypal. If he deposits the money there they may lift his bad credit status - not my problem. I just want the money back into my Paypal account which is what I use for all my internet payments.

I am still going to be out of pocket because Paypal will charge to transfer into my account but I will take this up with them later. I am just giving him one more chance to make things right - for himself.

I am that nice.. (everyone go OOhhhhhhh...)
